Terms of Service

Please read these Terms of Service ("Terms") carefully before using Watchover. By creating an account, clicking "I agree," or using any part of the Watchover service, you agree to be bound by these Terms. If you do not agree, do not use Watchover.

1. What Watchover Is — and What It Is Not

Watchover is an AI-powered message analysis tool. When a designated third party (referred to as a "Protected Person") forwards a text message, email screenshot, or other communication to a Watchover phone number, Watchover analyzes that communication and returns an automated assessment of potential scam risk.

Watchover is an informational tool only. It is not a security service, fraud prevention guarantee, financial advisory service, legal service, or law enforcement service. Watchover does not prevent fraud. Watchover does not guarantee that any message it assesses as low-risk is safe, or that any message it assesses as high-risk is a scam. Automated AI analysis is probabilistic by nature and will sometimes be wrong.

You must not rely on Watchover as your sole means of evaluating suspicious communications. If you or your Protected Person are uncertain about a communication, you should verify it independently by contacting the alleged sender through an officially published contact channel.

2. Eligibility

You must be at least 18 years of age to create a Watchover account. By agreeing to these Terms, you confirm that you are 18 or older. Watchover is not directed at children under 13, and we do not knowingly collect personal data from children under 13.

3. The Service

3.1 Account Registration

To use Watchover, you must create an account by providing a valid email address and payment information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

3.2 Protected Person Enrollment

During setup, you will provide Watchover with the name and mobile phone number of one or more Protected Persons — typically an aging parent or other family member. You confirm that:

  • You have obtained, or are reasonably authorized to obtain, the consent of the Protected Person to enroll their phone number in the Watchover service;
  • You have taken reasonable steps to make the Protected Person aware that messages they forward to the Watchover number will be analyzed by an automated AI system;
  • You have obtained, or are reasonably authorized to obtain, consent for the Protected Person to receive automated SMS messages from Watchover in response to their forwards;
  • You have authority, or reasonable authorization, to act on behalf of the Protected Person for the purpose of enrolling them in this service.

Watchover will send an onboarding SMS to the Protected Person's number confirming their enrollment and providing opt-out instructions. The Protected Person may opt out at any time by replying STOP.

3.3 Message Analysis

When a Protected Person forwards a message to the Watchover number, Watchover will:

  • Receive the forwarded content via SMS or MMS;
  • Process the content using an AI language model to assess potential scam risk;
  • Return an automated response to the Protected Person's phone number;
  • Log the forward, the content, and the AI-generated response in your account dashboard;
  • Send you a push notification or alert if the AI assessment identifies high-risk indicators.

All AI-generated assessments are clearly marked as automated analysis. No human reviews individual messages in real time.

3.4 Limitations of Analysis

Watchover's analysis depends on the content of the forwarded message and publicly available scam pattern data. Watchover:

  • May incorrectly classify a scam as legitimate, or a legitimate message as a scam
  • Cannot analyze verbal communications, in-person interactions, or content not included in the forwarded message
  • Cannot guarantee detection of novel, sophisticated, or highly targeted scams
  • Does not have access to the Protected Person's financial accounts, personal history, or previous communications with the alleged sender

The words "low risk," "looks legitimate," or similar language in a Watchover response do not mean the message is safe. They mean only that the AI did not detect common scam indicators in the content provided.

4. Subscriptions and Billing

4.1 Plans

Watchover offers the following subscription plans:

  • Standard: $9.99/month — covers one Protected Person, unlimited message forwards
  • Family: $14.99/month — covers up to three Protected Persons
  • Annual: $99/year (Standard) — 17% discount versus monthly billing

Prices are in USD and are billed in advance. We reserve the right to change pricing with 30 days' written notice to your registered email address.

4.2 Free Trial

Where offered, free trials are available for new accounts only. At the end of the trial period, your account will automatically convert to a paid subscription unless you cancel before the trial ends.

4.3 Automatic Renewal

All subscriptions renew automatically at the end of each billing period. You authorize Watchover to charge your payment method on file for each renewal period. You may cancel at any time in your account settings.

4.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to Watchover until the end of the period for which you have paid. We do not provide prorated refunds for partial periods.

4.5 Refunds

Except where required by applicable law, all payments are non-refundable. If you believe you have been charged in error, contact us at legal@watchover.me within 14 days of the charge.

4.6 Payment Processing

Payments are processed by Stripe, Inc. By providing payment information, you also agree to Stripe's terms of service. Watchover does not store your full payment card details.

5. SMS Communications and TCPA Compliance

5.1 Consent to Receive SMS

By enrolling a Protected Person's phone number, you confirm that the Protected Person has consented to receive automated SMS messages from Watchover, including:

  • An initial onboarding message upon enrollment
  • Automated responses to messages the Protected Person forwards
  • Occasional service messages relating to their enrollment status

Message and data rates may apply. The Protected Person's mobile carrier may charge for SMS messages received.

5.2 Opt-Out

The Protected Person may opt out of receiving SMS messages from Watchover at any time by replying STOP to any Watchover message. After opting out, the Protected Person will receive one final confirmation message and will receive no further automated messages. The account holder may re-enroll the Protected Person at any time through the account dashboard.

5.3 Your Responsibility

You are responsible for ensuring that you have proper consent before enrolling any phone number. Enrolling a phone number without the knowledge and consent of its owner is a violation of these Terms and may violate applicable law, including the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227. Watchover is not responsible for your failure to obtain proper consent.

6. Acceptable Use

You agree not to use Watchover to:

  • Submit messages containing passwords, PINs, banking credentials, Social Security numbers, or other highly sensitive authentication data;
  • Enroll phone numbers without the owner's knowledge and consent;
  • Attempt to reverse-engineer, scrape, or otherwise extract Watchover's underlying AI models or infrastructure;
  • Circumvent or test Watchover's security measures;
  • Use Watchover for any unlawful purpose or in violation of any applicable law or regulation;
  • Impersonate another person or misrepresent your identity or affiliation;
  • Transmit content that is threatening, harassing, or abusive.

Watchover reserves the right to suspend or terminate your account immediately if you violate this Section.

7. Intellectual Property

All content, software, trademarks, and other materials made available through Watchover are the property of Lars Peters or are licensed to Lars Peters. You may not copy, reproduce, distribute, or create derivative works from any Watchover materials without prior written consent.

You retain ownership of any content you or your Protected Person submits through the service. By submitting content, you grant Watchover a limited, non-exclusive, royalty-free license to process that content solely for the purpose of providing the service to you.

8. Privacy

Your use of Watchover is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Watchover, you agree to the data practices described in the Privacy Policy.

9. Third-Party Services

Watchover uses third-party services to operate, including Twilio (SMS infrastructure), Anthropic (AI analysis), Supabase (data storage), Stripe (payments), and Vercel (hosting). Your use of Watchover is subject to those providers' applicable terms. Watchover is not responsible for the acts or omissions of third-party providers.

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLEARED IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. CLEARED EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

CLEARED DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (B) ANY AI-GENERATED ASSESSMENT WILL BE ACCURATE, COMPLETE, OR RELIABLE; (C) THE SERVICE WILL PREVENT ANY FRAUD, FINANCIAL LOSS, OR HARM TO YOU OR YOUR PROTECTED PERSON; (D) THE SERVICE WILL DETECT ALL SCAMS OR FRAUDULENT COMMUNICATIONS.

CLEARED'S AI ASSESSMENTS ARE PROBABILISTIC ESTIMATES ONLY. THEY ARE NOT GUARANTEES OF SAFETY OR RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU ASSUME RESPONSIBILITY FOR ANY DECISIONS YOU OR YOUR PROTECTED PERSON MAKE IN RELIANCE ON CLEARED'S OUTPUTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLEARED'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE — WHETHER IN CONTRACT, TORT, STATUTE, OR OTHERWISE — SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO CLEARED IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR (B) TEN US DOLLARS ($10.00).

IN NO EVENT SHALL CLEARED BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR FINANCIAL LOSSES SUFFERED BY YOU OR YOUR PROTECTED PERSON AS A RESULT OF FRAUD OR SCAMS, EVEN IF CLEARED HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, CLEARED'S LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to defend, indemnify, and hold harmless Lars Peters and Watchover from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of Watchover in violation of these Terms;
  • Your enrollment of a phone number without the owner's consent;
  • Any content you or your Protected Person submits through the service;
  • Your violation of any applicable law or the rights of any third party.

13. Dispute Resolution and Arbitration

13.1 Informal Resolution

Before initiating any formal dispute process, you agree to contact Watchover at legal@watchover.me and provide a written description of your claim. We will attempt to resolve the dispute informally within 30 days.

13.2 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the service shall be resolved by binding individual arbitration rather than in court, except as provided in Section 13.4 below.

Arbitration shall be conducted by a recognized arbitration body under its consumer arbitration rules. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

This arbitration clause does not apply where prohibited by mandatory consumer protection law, including applicable EU consumer protection law that grants consumers the right to bring proceedings before the courts of their Member State of residence.

13.3 Class Action Waiver

YOU AND CLEARED EACH WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. ALL DISPUTES MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY ONLY. THIS WAIVER APPLIES TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

13.4 Exceptions

Either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent imminent harm, and either party may bring claims in small claims court if the claim qualifies.

13.5 Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, without regard to its conflict of law principles, except that the arbitration provisions shall be governed by applicable arbitration law. For US consumers, nothing in these Terms limits any consumer protection rights you may have under applicable US federal or state law.

14. Changes to These Terms

Watchover reserves the right to modify these Terms at any time. We will notify you of material changes by sending an email to your registered address at least 14 days before the changes take effect. Your continued use of Watchover after the effective date of revised Terms constitutes your acceptance of those Terms. If you do not agree to the revised Terms, you must cancel your subscription before the effective date.

15. Termination

Watchover may suspend or terminate your account at any time for violation of these Terms, non-payment, or for any other reason with reasonable notice. Upon termination, your right to use the service ends immediately. Sections 10, 11, 12, 13, and 15 survive termination.

16. Severability

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Watchover regarding the service and supersede all prior agreements, representations, and understandings.
